INTRODUCTION

Property Portal Limited (we, us, our) complies with the New Zealand Privacy Act 2020 (the NZ Privacy Act). Personal information is information about an identifiable individual (a natural person).

This policy sets out how we will collect, use, disclose and protect your personal information when you access and use our website and/or our software-as-a-service offering known as Relab at www.relab.co.nz or have other dealings with us.

We may change this policy by uploading a revised policy onto the website. The change will apply from the date that we upload the revised policy.

WHAT PERSONAL INFORMATION DO WE COLLECT

We collect, hold and process three categories of personal information: Account and Marketing Data, Client Data and Third Party Data.

  • Account and Marketing Data is personal information that we collect about you: 
    • in connection with the creation or administration of a customer account
    • if you ask to receive information about us or Relab or sign up to our newsletter 
    • when you sign up to or access or use Relab (paid or free)
    • when you contact us directly (e.g. telephone call, website enquiry form, email or through your user dashboard) or visit our website

The Account and Marketing Data we collect may include company/personal names, usernames, phone numbers, email addresses and any other contact information you provide to us, your location, billing information, purchase history, information about how you use our website and/or Relab (for example, traffic volumes, time spent on pages), your IP address and/or other device identifying data, information contained in your correspondence with us and other information required to provide a service or information you have requested from us.

Client Data is personal information that forms part of the Data (as defined in our Terms of Use ). This may include any personal information collected by our clients. We will not collect or process Client Data except as provided in our Terms of Use and/or other agreements with our clients that govern the processing of Client Data (as applicable) and we require our clients to comply with applicable privacy and data protection laws.

The remainder of this privacy policy sets out how we will collect, use, disclose and protect Account and Marketing Data and Third Party Data and does not apply to Client Data.

WHO DO WE COLLECT YOUR PERSONAL INFORMATION FROM

We may use Account and Marketing Data:

  • to provide the website and Relab to you
  • to market Relab and any related services to you, including contacting you electronically (e.g. by text or email for this purpose). You can stop receiving our marketing emails by following the unsubscribe instructions included in those emails
  • to improve Relab and any services that we provide to you
  • by recording clickstream data, which is non-personal information that is recorded when you click anywhere on a webpage and is used for the purposes of collecting, analysing and reporting data about how you use our website, Relab and related services; and
  • through the use of cookies, web beacons and similar storage technologies.

We collect Third Party Data directly from third parties and not directly from individuals because that would not be reasonably practicable.

HOW WE USE YOUR PERSONAL INFORMATION

We may use your personal information:

  • to provide the website and our services to you
  • to market our services to you, including contacting you electronically (e.g. by text or email for this purpose). You can stop receiving our marketing emails by following the unsubscribe instructions included in those emails
  • to improve Relab and any services that we provide to you
  • to respond to communications from you, including enquiries and complaints,
  • to conduct research and statistical analysis (on an anonymised basis)
  • to tailor content or advertisements to you
  • to protect and/or enforce our legal rights and interests, including defending any claim
  • for any other purpose authorised by you, the Privacy Act or other applicable law
  • to respond to lawful requests by public authorities, including to meet law enforcement requirements. 

We may transfer Account and Marketing Data in the case of a sale, merger, consolidation, liquidation, reorganisation or acquisition.

We may use Third Party Data:

  • to provide Relab to our customers
  • to develop and improve Relab and any other services we offer to our customers
  • to conduct research and statistical analysis (on an anonymised basis)

DISCLOSING YOUR PERSONAL INFORMATION

We may disclose Account and Marketing Data to:

  • any business that supports Relab, including any person that hosts or maintains any underlying IT system or data centre that we use to provide our website or Relab
  • other third parties (for anonymised statistical information)
  • to improve Relab and any other services that we provide to you
  • a person who can require us to supply your personal information (e.g. a regulatory authority)
  • any other person authorised by the Privacy Act or other applicable law (e.g. a law enforcement agency)
  • professional advisers e.g accountants, lawyers, auditors
  • any other person authorised by you
  • any other company in the case of a sale, merger, consolidation, liquidation, reorganisation or acquisition.

We share information about your use of the website with our trusted social media, advertising and analytics partners through the use of cookies, web beacons and similar storage technologies. Please refer to the Cookies section below for further information.

We make Third Party Data available via Relab to our customers. Some Third Party Data (such as ownership information) is only available to users of the professional version of Relab. Third Party Data that is unconditional sales data sourced from the Real Estate Institute of New Zealand (REINZ) is only available to members of REINZ and subject to various other restrictions set out in our terms of use.

PROTECTING YOUR PERSONAL INFORMATION

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse. We implement appropriate technical and organisational measures to ensure a level of security appropriate to risks inherent in processing personal information.

You can play an important role in keeping your personal information secure by maintaining the confidentiality of any password and accounts used in relation to our services. Please do not disclose your password to third parties. Please notify us immediately if there is any unauthorised use of your account or any other breach of security.

ACCESSING, CORRECTING AND DELETING YOUR PERSONAL INFORMATION

Subject to certain grounds for refusal set out in the Privacy Act or other applicable law, you have the right to access your readily retrievable personal information that we hold and to request a correction, or deletion to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

In respect of a request for correction if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

If you want to exercise any of the above rights, email us at support@relab.co.nz. Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or correction, or the deletion that you are requesting). We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.

If the personal information that is the subject of a request for correction or a deletion is Third Party Data, we may refer you to the third party who provided us the information to process your request.

INTERNET USE

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.

If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site's privacy policy before you provide personal information.

COOKIES

We use cookies (an alphanumeric identifier that we transfer to your computer's hard drive so that we can recognise your browser) to monitor your use of the website. You may disable cookies by changing the settings on your browser, although this may mean that you cannot use all of the features of the website.

We use Google Analytics to collect information about visitors to our website. Google Analytics collects information related to your device, browser, IP address, network location, and website activities to measure and report statistics about your interactions on our website. We use this information to help us manage the performance and design of our website and to improve our website.

We use Google Analytics Advertising Features, including Remarketing with Analytics, Demographic and Interests reporting in Analytics, Campaign Manager integration (formerly known as DoubleClick), Display & Video 360 integration, Google Display Network (GDN) Impression Reporting and Segments. We also use Google Ads.
